John M. Leverett represents and advises real estate developers and builders throughout California in the conception, planning, documentation, and implementation of common interest developments and development projects, including master planned developments, mixed-use urban developments, high-rise condominiums, age-qualified residential communities, transit-oriented developments, custom lot subdivisions, and commercial/industrial projects.
Regulatory Compliance. Mr. Leverett regularly advises residential and mixed-use developers on compliance with the requirements of state agencies including the California Bureau of Real Estate and the California Coastal Commission, cities, counties, and special districts.
Project Approval. Mr. Leverett also has extensive experience in advising residential developers on ensuring compliance with project approval requirements of FHA, VA, Fannie Mae and Freddie Mac, including project design and structuring the offering.
Special Development Issues. Mr. Leverett has significant experience advising developers on governance and compliance issues encountered in hotel/retail/residential mixed-use developments, age-qualified communities, urban infill, adaptive re-use, live-work projects, and residential development on former industrial and petroleum producing lands. Mr. Leverett has advises many developers, foreclosing lenders and agencies in pre-acquisition due diligence and in restarting the development and sale of “broken” residential and commercial projects.
Builder Risk Management. Mr. Leverett also regularly advises residential developers and converters on construction defect risk management, including structuring protective provisions in governance and sales documents, and the preparation of special disclosures.
